How to defend against charges of operating a vehicle impaired

First and foremost, operating a vehicle while impaired (OVI) in Ohio is just another way to say driving under the influence or driving while intoxicated. It encompasses both alcohol and drugs when operating a vehicle. If you face an OVI charge, either for the first time or a subsequent time, you need to know the best ways to fight that charge in Dayton so you can get back to your life.

You need to take a long look at how the traffic stop was conducted that led to your OVI charge. The officer needed to have reasonable cause to initiate the traffic stop in the first place. This means that you had to have broken a law or some other traffic violation for a stop to have been initiated.

Another defense to an OVI charge is that the breathalyzer test was not administered properly. You can call into question whether or not the device was calibrated properly, whether or not the officer was properly trained to use the device, and if the test was administered within a reasonable frame of time following the traffic stop.

When facing an OVI charge you can also use the defense of improper handling of a sample. If you gave a blood sample at the hospital or police station, it has to follow a specific chain of command. If the chain of command is broken in anyway possible you could challenge this during a court appearance.

OVI charges do not mean that you will be without a driver's license for months on end or tossed behind bars. You need to examine the charge in West Chester, Ohio and begin mounting your defense as soon as possible.
